The Special Iraqi Tribunal Court “The Iraqi War Crimes Court” for the trial of Saddam Hussein and his Ex-Baath Regime,

The Case   :    The Illegal Deportations of Thousands of Faily Kurds and other Iraqi

citizens to Iran  from 4th April 1980 to 1990 and the disappearance of their detained Hostages in Iraq.

 

 

The Charges Pressed and Presented by The Committee for the Release of Hostages and Detainees in Iraq (CROHDI).

 

The Charges against Saddam Hussein, his half brother Barzan Al-Tikriti and their

ex-regime are as follows :

 

1.      The forceful and inhuman deportations of about a million of Iraqi

citizens – families to Iran in the period of 4th April 1980 to 1990.

In the midst of the deportation at the Iraq-Iran border, some families were forcefully made to walk through land mine areas, resulting in many innocent men, women and children perishing.

(Please refer to the RED CROSS & RED CRESENT and the Iranian Government reports, BBC news for that period of time and the archives of The Free Prisoners Association-Baghdad. For example my family, my 3 uncles and 4 aunties and their families and many of my immediate relatives were deported).

 

2.    Hostage taking of Iraqi citizens from their deported families, illegal   

imprisonment, torture, and disappearance.

Until now we do not know what Saddam Hussein, Barzan Al-Tikriti (he was in charge of the hostages detained while they were kept in the Abu Ghraib Prison from 1980 to 1984) and his ex-regime had done with them or where they were kept (for example, my brother Jamal and eleven of my immediate cousins, many relatives and fellow citizens). Our hostages’ committee has in total the names and details of over 900 disappeared hostages. These lists are in this committee’s web site in Arabic and English.

 

3.      The confiscation of properties, belongings, businesses and money deposits in  

      Iraqi Banks, Iraqi citizenships and passports documents from these deported families.

 

4.      Forcing the spouses of members of the deported families to divorce and separate from their spouses and to marry members of the Baath party to stay in Iraq.

 

5.    The deportations of tens of children and disabled people

Young children were deported without parents or guardians. A number of severely disabled people were deported without care assistants, family members or other support. These deportations took place in harsh weather conditions.

 

6.      The use of some detained hostages in chemical and biological experiments

SUMMARY

Deportations

  • April 1980 - 1990 approximately one million Iraqi citizens (more than half were Faily Kurds) were forcibly deported to Iran by direct orders from Saddam Hussein.
  • The deportations commenced six months prior to the start of the Iraq/Iran war.
  • The deportees were accused of being of Iranian origin.
  • Their belongings and Iraqi citizenship documents were confiscated.

 

Reasons for the Deportation

  • Many of the deportees were wealthy and the ruling Baath Party wanted their wealth for its own supporters.
  • Many of the deportees were not supporters of the Baath Party or not trusted by the Regime.
  • Many of the younger deportees were well educated and the Baath Party feared their future influence.

 

Hostage Taking

  • To silence protest members of each family of deportees were detained as hostages.
  • Approximately one detainee for every 10 deportees.
  • These hostages were mainly men 16-40 years of age, and also included children and the elderly.
  • Many hostages were on National Service when arrested.
  • The hostages were imprisoned in various prisons and transported between prisons.
  • Abu Ghraib and Qalat Al-Salman were 2 of the main prisons where hostages were kept.
  • At least 4 thousand hostages are still un-accounted for and this committee has the names, details and evidence of over 900 of these disappeared Iraqi hostages.

 

CONCLUSION

On the 1st of July 2004, your court had read out only SEVEN main charges against Saddam Hussein and his top Baathist aides. Whereas in this presented case, Saddam Hussein had carried out his first mass genocide against the Iraqi people that was followed by the genocide crimes of the other 7 charges this court had read out to them.

Which brings about the obvious question - why was this atrocious crime forgotten and dropped from his court appearance?

 

Saddam Hussein’s despicable act cannot be erased from the minds of the victims and must be brought to the face of justice.

This 8th charge is an equally vital crime and case against Saddam Hussein and his top aides. Respectively, this committee requests this special court to bring forward Saddam Hussein, his top aides and his half brother Barzan Al-Tikriti again to read out all our charges mentioned above against them.

 

The committee is able to provide this court with material evidence and present witnesses who were deported, the relatives of the hostages, and the released ex-hostages whenever your court requires. 

 

We strongly urge your court to take on this honorable, humanitarian duty to try Saddam Hussein and his ex-Ba’ath regime who committed these crimes. This will be a symbol of justice in Iraq.
